1. Controller

2. Third-Party Service Providers

Caply does not operate this online shop on its own infrastructure. We use the services of the following third-party providers. Each is independently responsible for the security and processing of the data entrusted to them:

Shopify Inc. (Ottawa, Canada / Dublin, Ireland) — E-commerce platform, payment processing, hosting. Shopify processes order data, customer data, and payment information in accordance with its own privacy policy: shopify.com/legal/privacy. Caply does not have access to full credit card details.
Gelato AS (Oslo, Norway) — Production and fulfilment partner. To fulfil orders, we transmit your name, delivery address, and order details to Gelato. Gelato processes this data in accordance with its own privacy policy: gelato.com/privacy-policy.
Shipping carriers (e.g. Swiss Post, DHL) — Receive your name and delivery address for parcel delivery. This data is forwarded by Gelato.
Google LLC — Analytics (where consent has been given): usage statistics to improve the shop. Privacy policy: policies.google.com/privacy.
Meta Platforms Inc. — Meta Pixel (where consent has been given): analysis of advertising campaigns. Privacy policy: facebook.com/privacy/policy.

Caply is not liable for data protection breaches caused by the above-mentioned third-party providers. In the event of a claim, please contact the relevant provider directly.

4. Data Retention

Personal data is retained only for as long as necessary for the relevant purpose. Business records are retained in accordance with Art. 958f CO for 10 years. Data that is no longer required will be deleted on request, unless a statutory retention obligation applies.

5. Cookies

This website uses:

Technically necessary cookies: Required for the operation of the shop (shopping cart, session, authentication). No consent required.
Analytics cookies (Google Analytics): Only with your explicit consent. Can be disabled in your browser settings or via the cookie banner.
Marketing cookies (Meta Pixel): Only with your explicit consent.

Caply is not responsible for cookies set independently by Shopify, Google, or Meta. Responsibility lies with the respective third-party providers in accordance with their own privacy policies.

6. Your Rights (revDSG)

You have the right to:

Access your stored data
Correction of inaccurate data
Deletion (where not subject to a statutory retention obligation)
Portability in machine-readable format
Withdrawal of any consent given

7. Limitation of Liability — Data Protection

Caply takes all reasonable technical and organisational measures to protect your data. As the shop is operated on Shopify Inc.'s infrastructure and orders are processed via Gelato AS, Caply cannot accept liability for data protection breaches that occur within the sphere of responsibility of these third-party providers. This limitation of liability does not apply in cases of wilful misconduct or gross negligence by Caply (Art. 100 CO).
